Notice to Midwest Energy Members on Self-Regulation

On May 10, 2013, Midwest Energy members voted 72% to 28% in favor of becoming a self-regulated cooperative.  On June 5, 2013 the Kansas Corporation Commission released Midwest Energy from its jurisdiction in certain matters.

Notice to Members

In balloting that ended May 10, 2013, members of Midwest Energy, Inc. approved the proposition that Midwest Energy be exempt from the jurisdiction, regulation, supervision and control of the state corporation commission (KCC) on certain matters pursuant to K.S.A. 66-104d and K.S.A. 66-104g.  By order dated June 5, 2013, the KCC affirmed this exemption.On May 20, 2013 the Midwest Energy Board of Directors passed a resolution adopting the rate schedules, terms, conditions and other policies related to its customers, as each existed on May 10, 2013, to be effective as of the date of deregulation, until such time as the rate schedules, terms, conditions and other policies are changed in accordance with applicable law.  As a result, existing agreements, contracts, retail tariffs and other legal documents that reference approval by the KCC are now subject to the authority of Midwest Energy’s Board of Directors.  Customers or members having questions about this matter or specific Midwest Energy contracts and agreements to which they are a party should contact:
